These Terms of Service ("Terms") govern your access to and use of StatMD (the "Service"), a live classroom polling application operated by PharmaByMD ("we", "us"). By creating an account or using the Service, you agree to these Terms.
StatMD lets hosts run live polls, quizzes, word clouds and Q&A, and lets participants respond from their own device. StatMD is a digital online service — there is no physical product and nothing is shipped.
You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity under your account. You must be at least 13 years old to create a host account.
You agree not to use the Service to post or collect unlawful, infringing, harassing, hateful or misleading content; to send spam; to attempt to disrupt, overload or gain unauthorised access to the Service; or to violate the rights of others. As a host, you are responsible for the content you create and for any participant data you choose to collect.
StatMD offers a Free plan and paid Pro options shown on our Pricing page. Fees are displayed in Indian Rupees (INR) and processed by our payment partner, Razorpay. Subscriptions renew automatically for the chosen period until cancelled. Applicable taxes may apply. Cancellations and refunds are governed by our Refund & Cancellation Policy.
You retain ownership of the questions and other content you create. You grant us a limited licence to host, store and display that content solely to operate the Service for you. Participant submissions are displayed live during a session.
The Service is provided on an "as is" and "as available" basis. We may modify, suspend or discontinue features at any time, and we do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for loss of data or profits, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the three months before the claim.
You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms. On termination, your right to use the Service ends.
These Terms are governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the competent courts in India.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service means you accept the updated Terms.
